Anna Nicole Smith's Body is cleared to go to the Bahamas

The wrangling over Anna Nicole Smith's body appeared to end Wednesday when her mother's lawyer said she would not stand in the way of the starlet's burial in the Bahamas later this week.

Tom Pirtle said Wednesday night that Virgie Arthur would not challenge a Florida appeals court ruling Wednesday that cleared the way for the burial.

"It's going to be difficult to appeal the ruling, so we're not going to appeal," Pirtle said.

Arthur had fought last week's ruling from Circuit Judge Larry Seidlin that gave control of Smith's body to an advocate for Smith's 5-month-old daughter, Dannielynn. Arthur had wanted to bury Smith in her home state of Texas,

But Smith's boyfriend, Howard K. Stern, argued that she had wanted to be buried in the Bahamas next to her 20-year-old son, who died last year of apparent drug-related causes. The 4th District Court of Appeal agreed.

The trial court concluded that Smith's "last ascertainable wish" was to be buried alongside her son. "This finding is not essentially disputed," the appellate judges said in their ruling.

Another attorney for Arthur, Roberta Mandel, had said earlier Wednesday that she was prepared to appeal to the state Supreme Court if the appeals court did not find in her client's favor.

Smith's body has been stored at a medical examiner's office since shortly after she died Feb. 8 at 39. A cause of death has not been determined.

Lawyer Richard Milstein, the baby's advocate, said in a statement Wednesday after the ruling that the funeral was set for Friday.

He declined to comment further, saying he wanted to "uphold the decorum and dignity that should be maintained throughout this process, for the sake of Dannielynn and the memories she will have of her mother's funeral."

Wayne Munroe, the Bahamian attorney for Smith's estate, said Wednesday's ruling by the Florida court was "common sense."

"Everyone in this whole saga knows what her wishes were about every aspect of her affairs - custody, property, everything. But people are steadfastly trying to get their wishes met and not hers. Nobody seems to care about this woman's wishes."

It was not immediately clear when the body would be moved.

Dr. Joshua Perper, the Broward County medical examiner, said that embalmers would have to take another look at the body, but that he hopes it is "in such condition that a second viewing will be possible." Stern, Arthur and others have been allowed to view the body at Perper's office.

A judge in the Bahamas is hearing the child custody dispute between Arthur and Stern, who is listed as Dannielynn's father on the birth certificate. On Tuesday, Arthur saw the little girl for the first time and left the home in tears.

Besides Stern, two other men claim to be the father.

In Fort Lauderdale on Wednesday, Judge Lawrence Korda ordered DNA samples from Smith's body be turned over to attorneys for photographer Larry Birkhead, an ex-boyfriend of Smith's. Frederic von Anhalt, the husband of actress Zsa Zsa Gabor, also says he could be the father. But Korda said he had no jurisdiction to do anything further.

"The Bahamas is the proper venue, and the Bahamian court has already exercised jurisdiction over the minor child," Korda said.

Smith married Texas oil tycoon J. Howard Marshall II in 1994 when he was 89 and she was 26. The reality TV star and Playboy Playmate had been fighting his family over his estimated $500 million fortune since his death in 1995, and her baby daughter could inherit millions.

Paris Hilton Violates Her Probation

Paris was stopped by police around 10:30 PM last Tuesday evening after cops say they noticed Hilton speeding down Sunset Blvd. without headlights. Deputies then discovered she was driving with a suspended license, arrested the heiress and impounded her car.

TMZ has confirmed that Paris Hilton violated the terms of her probation and could spend up to 90 days in jail as a result.

Paris could have her probation revoked if she is found to have been driving with a suspended license because it would violate conditions of her previous sentence for reckless driving, authorities said Wednesday....

A hearing will be set to discuss Hilton's violation.

Last years American Idol Winner, Taylor Hicks, is asking The Soul Patrol to kick it up a notch.

Britney is Suffering From Post-Partum

Promises Clinic staffers found Britney's "death list" after stripping Spears when they suspected she smuggled cocaine into the facility. The list included Kevin Federline and several members of the paparazzi. A source said:

Bobby Brown Ordered Jailed Until He Pays $19K

Bobby Brown was ordered on Monday to remain in a county jail until he pays $19,000 in late child support and court fees, his lawyer said. "We're diligently working on getting those funds available from outside sources," said Phaedra Parks, an attorney in Atlanta where Brown currently lives. Parks doubted Brown would get out of jail before Tuesday morning.

Parks said the rhythm-and-blues singer has been struggling to meet monthly payments to Kim Ward, of Stoughton, the mother of his two teenage children.

Apparently there have been rumors that Britney was on suicide watch and that she tried to commit suicide twice before she went to rehab. Her manager has advised the press that the rumors are not true. However , he did admit that Britney needs help. We have been told she has a good support system and she should be well enough to see her kids soon.

Kevin Federline made a visit to the promises Rehabilitation Center to spend time with his ex, Britney Spears. Apparently the visit went well. K-Fed is encouraging here to get well so she can see her kids again. It is very possible they may get back together.

I seriously don't think rehab is her issue. She freakin crazy. She should be in a mental hospital and in a straight jacket. Not to mention, that picture scares the hell out of me.

The Anna Nicole Smith Circus Continues

The paternity suit is beginning today in Florida. Howard K. Stern's Attorneys along with representation for Larry Birkhead are in court with Judge Lawrence Korda. This Judge will not move as quickly as Judge Siedlin. He may not even have Jurisdiction.

"An attorney for Larry Birkhead is expected to ask the judge to order a DNA sample to be collected from the 5-month-old baby from the Bahamas, or for the baby to go to Florida for the testing. "

I am absolutely exhausted with this story. Larry Birkhead and Virgie Author will not give up. We must remember that the baby is in the Bahamas. Laws are different there. This is why the lawyers do not want to deal with it over there. In the Bahamas there is no guarantee, if you prove you are the biological parent, that you will automatically get custody. Their laws demand that they choose the best parent.

Now, we all know besides the drugs, 2 people have died around Howard K. Stern. I can't see them choosing him. However it could be years before they make the decision. Those years will give Bahamian court time to re-evaluate Howard K. Stern and Larry Birkhead. Dannielyyn may be a toddler by the time it is settled.

Note: Virgie Author has filed an appeal. To stop the burial of Anna Nicole in the Bahamas. Anna Nicole Smith's body is decomposing quiclky. However, the Texas woman placed the blame squarely on the judge who issued the decision. Circuit Judge Larry Seidlin "took four, five days to do what would only take normal judge one day, maybe a couple of hours to do," Virgie Arthur told TODAY host Matt Lauer in an exclusive live interview. "Maybe he wants to be a movie star."

Dannielynn Has Custody of Anna Nicole Smith's Body

After a very tough day in the court room which included testimony from Larry Birkhead and a handful of others who knew Anna Nicole Smith. Judge Larry Siedlin has ruled that Dannielynn, represented by the Guardian ad Litem, will have custody of Anna Nicole's body. The Judge strongly recommended that Anna Nicole be buried with her son in the Bahamas. Hear that?: Strongly recommended. That means Mrs Flintstone or Norma Jean or Vikki Marshall or whatever her name was, will be buried in the Bahamas. RIP.

Unfortunately it is not completely over. Since the Guardian Ad Litems office has custody, Mr Milstein will have to mediate the details. The body will go to the Bahamas. The Judge gave the marching orders after saying he ruled with Milstien. God morning , Good afternoon , Goodnight.

Howard K Stern, Larry Birkhead and Virgie Author emerged fro the court house and announced what I already new. Anna Nicole will be buried in the Bahamas. Strangely enough, they all came out together. Yes Together. Ms. Opri also stated and was overly thankful, that Howard had granted Larry Birkhead permission to see Dannilynn at the funeral.

I guess every one is going kiss up to Howard for a little while. He currently has control of everything.

This has been the craziest court coverage I have ever seen. I'm exhausted. Next item... Paternity.

Britney Is Mad and Back in Rehab..3rd Try

I have just been notified that last night Britney Spears returned to the treatment center, Promises, in Malibu, CA. Is 3 the magic number?

There is video of Spears entering the center with her mother, Lynne Spears. Lynne is driving, she buzzes the intercom and the two drive through the gates. Spears' inpatient rehab program is supposed to last between 30 and 45 days.

Additionally, I was told about an incident earlier in the evening between Spears and her estranged husband, Kevin Federline.

X17online.com is reporting that Spears went to Federline’s house last night. Their two children were inside the house and Federline would not let Spears inside.

Spears then turned on the camera men outside the home flailing her arms and hitting the cameras.

We're told Spears showed up at Federline's house to see the children last night and he wouldn't let her in.

Sources say the kids are now in the custody of Federline, and have been since last week.


Here I come with some more predictions. This rehab stint will not last thru 10am tomorrow morning. If you read below . K-fed is coming for the kids. She is toast and she will not sit still.

I have 3 TVs and 3 computers on trying to keep up with all this shit. Is it the end of the world? People! tell your kids .. Say no to drugs.

Larry Birkhead is on Cross Examination

The Court hearing on the burial of Mrs. Flinstone, oops sorry...I mean Anna Nicole Smith, is back in session. Larry Birkhead is on the stand. In Addition, it is being reported that the infamous Face Painted Video will be aired in court today.

I will post ridiculous updates here, and there will be many, as they come in. The Face painted video is hear to so you can familiarize yourself with it.

Currently we are waiting for Virgie (Anna's Mom) to arrive. I' m sure she's waiting for her ride, Splash News, to pick her up.

Give Me My Kids Beeotch!

TMZ has learned that Kevin Federline has asked a judge for an emergency hearing on Thursday to discuss his custody dispute with estranged wife Britney Spears.

A court spokesperson says only K-Fed and his attorney are scheduled to appear before the judge, but adds "anything is possible."

Federline filed papers in November seeking spousal support and sole custody of the couple's children- 5-month-old Jayden James and 17-month-old Sean Preston. As TMZ previously reported, a temporary court order granted the couple joint custody, with Spears having primary physical custody of the boys.

Now, with Spears' recent erratic behavior, coupled with the fact that she's been in and out of rehab twice in the last week, all bets may be off.

These two are a mess. Take a look at both pictures. Think about this; K-FEd is dad and Britney Spears is mom. The kids don't have a chance.

Anna Nicole Smith’s mom was on the hot seat yesterday after she was allowed to visit her daughter’s body at the morgue and brought a gossip Web site reporter along for the ride.

Virgie Arthur squirmed on the witness stand in Broward County Court yesterday afternoon when it was disclosed that she was driven to the lunchtime morgue visit by a reporter for Splash News. Arthur described the reporter as a "close family friend," but she stumbled when asked where the man lived.

Splash News is an entertainment Web site that pays money for photos, stories and tips about celebrities.

Arthur denied she has received any cash from Splash, but hedged when asked whether she has been promised any or has signed any contracts with the agency.

Britney Checks Herself Out of Rehab.. Again

I predicted in an earlier post that by noon Britney Spears would walk out out of rehab. ( Pat on the back ) I'm starting to believe that she is competing with the Anna Nicole story and trying her best to stay in the news. I mean she is doing this on purpose, just in case you misunderstood. I heard that the Hairdresser from the salon where Britney Sheared herself called and spoke to Ryan Seacrest . She told him that she believes this is all a publicity stunt. I am inclined to believe that now. I'm also inclined to believe the hairdresser wants to profit from all the fiasco. Either way Britney is mentally ill. She need help. People close to her says she could be going through postpartum depression. I hope they keep her away from her kids . With this kind of behavior, they are clearly in substantial danger. Britney needs to call Brooke Shields and get some Prozac right away.

MSNBC is reporting that. Keven was planning to have Britney's hair tested for drugs and that is was why she shaved her hair.

"They had a huge argument. Kevin threatened Britney that he was going to have people test her hair to find out exactly what she's been up to. She was so scared. That was what made her have her head shaved."

Update One (10:00 am)

We're just getting started , Judge Siedlin arrived late. He asked Howard K. Stern to arrive at 9 am and promised to release him at 11 am . We don't know if he plans to honor that or not. The Judge has opened session in his normal fashion. He is still talking a bunch of BS. We're waiting for some relevant proceedings.


Update Two (11:00 am)

The proverbial Doo Doo is hitting the fan. The Judge is still a jackass. I'm sorry I don't have a better word to depict him. He leads the witness, in this case Virgie Author, through all the questions. He makes jokes all the time. I thought he was trying to get this hearing completed. I'm not going to lie there is a lot of bullshit in this court room . Train Wreck doesn’t even begin to describe what’s going on here. Virgie is being given a whole lot of credibility, but I’m sure we can all see she is a fraud and a liar. This woman may just be “dumb“. Its hard to believe she was a cop for 20 plus years. She cant even do simple math. Maybe I’m ignorant , are cops really that dumb? Example: Your grandson was born in 1986 how old was he in 1996? Unbelievable. During the cross examination she breaks down when she cant explain herself. She is a big fat liar.

Update Three (12:00 pm)

Its even more clear now that Virgie is a liar. Its as if she was so articulate earlier today , and now with question from Sterns attorney and the guardian ad litem she is a deer in the head lights and can't understand anything. She had stated that she didn't get any money from any news agency. She said she is not the one profiting but Howard is. The Judge wants a representative from Splash news to come to court . That would be great if Splash would testify. Then we' ll really see a circus. Judge Larry Seidlin insisted that his courtroom is not a three-ring affair. "There's no circus here, my friend," he told lawyers, after accusations flew from lawyers and litigants alike that Howard K. Stern and Virgie Arthur are profiting from Anna Nicole Smith's death.

Larry Birkhead has taken the stand now in the Anna Nicole hearings. These are going LATE.

Court is in recess until 10:30 tomorrow morning. Larry Birkhead will still be on the stand.

• Crazy ass lawyer went BALLISTIC on judge and Howard, yelling "who’s the father! who’s the father!"

Sylvester Stallone Has a Great Mullet

Sylvester Stallone's private jet, limo, and hotel room were raided by authorities yesterday after “suspicious activity” was reportedly seen from the balcony of his luxury suite at the Park Hyatt.

Stallone, 60, was on his way back to L.A. after promoting his latest Rocky film but was allegedly seen trying to dump illegal substances off his hotel room’s balcony. Authorities searched Stallone’s possessions, seized material and is continuing its investigation.

Stallone was eventually allowed to fly out last night and, if found guilty, could serve up to five years in jail and/or $110,000 in fines.

He was also beaten and pepper sprayed for sporting this ridiculous Mullet.

James Brown Will Finally be Buried

The AP reports:

" The six adult children of singer James Brown have agreed with his partner, Tomi Rae Hynie, on where the entertainer will be buried, an attorney for the woman said Tuesday.

Hynie's attorney, Robert Rosen, said the resting place is being kept confidential at the request of Brown's children. Rosen said the burial may take place in the "next few days." An attorney for Brown's children would not discuss specifics of any burial plans, but he said an agreement was being worked out.

Brown died Christmas Day at age 73. His body is being kept in a confidential location, said Charles Reid, manager of the C.A. Reid Funeral Home in Augusta, Ga., which handled Brown's funeral.

He said he checked on Brown on Tuesday, opening the gold casket to view the body.

"I do that constantly," Reid said. "That's the only way I can actually check him ... go in, open the casket and close it. And he's fine."

Meanwhile, a South Carolina judge in a ruling made public Tuesday said the trustees accused of mismanaging Brown's estate will keep handling his property and trust, but a special administrator will oversee their work.

The singer's six adult children were in an Aiken County court Feb. 9 in an attempt to remove three trustees who are handling the late singer's estate. They claim it has been mismanaged.

The children and Hynie had both asked the court to appoint a special administrator to oversee the trust.

"We told the court that we had no objection whatsoever to a special administrator and the court has now ruled that there were no improprieties on the part of the personal representatives," Dallas said.

Brown's children claimed in court papers last month that trustees had "mismanaged and otherwise dissipated assets and income of the trust to the detriment of James Brown" and that some of Brown's assets were in danger of being "lost or dissipated or stolen."

The trust is said to contain most of Brown's primary assets, including the late singer's music rights and his 60-acre Beech Island home, and is separate from Brown's will filed last month. The will called for personal possessions such as clothes, jewelry, boats and automobiles to be divided among the children.

Dallas said the children's petition "delayed the wishes and legacy of Mr. Brown." But it won't likely be the last hearing over the singer's estate.

Charles Reid actually goes and opens the casket every few days. That's gross . Can you imagine the stench? I thought Anna Nicole was the only one with burial delays. This has been since CHRISTMAS!

Britney Spears in Rehab ..Again

Britney Spears has voluntarily checked herself into "Promises" rehab facility in Malibu today.

Rudolph says in a statement. "We ask that the media respect her privacy as well as those of her family and friends at this time."

The latest news caps off a wild holiday weekend for the pop star, who shaved her head, got two new tattoos and was spotted partying in West Hollywood over the last several days.

Last week Spears, 25, visited Crossroads Centre in Antigua but left after just one day and headed to Florida.

This is the latest picture of Britney in strolling around "Promises" the Rehab facility in Malibu.

Privacy? Geez, TMZ already has helicopters flying around that place. ..I'm also hearing rumors that Britney will give custody of her children to her mother , to keep Kevin from getting them.
